Section 20
PROCEDURE FOR AUCTION SALE OF PROPERTY OR INSTRUMENT
(1) After evaluating the assets or instruments confiscated in accordance with this Act in accordance with Section 18, the department or the relevant district administration office shall auction such assets or instruments in public.
(2) According to sub-section (1), when assets or instruments are sold by public auction, depending on the nature and value of such assets or instruments, a notice of seven days to thirty-five days shall be published in a national level newspaper. However, according to Section 21, during auction sale of property or equipment, or during auction sale of property or equipment whose value is less than fifty thousand rupees, a notice shall be posted in the District Administration Office, Treasury and Accounts Controller's Office, relevant office, industry and commerce association and local body's office related to auction sale. Action can be taken.
(3) The person who wants to participate in the auction sale conducted according to sub-section (2) shall deposit the specified amount in the deposit account specified by the department or the relevant district administration office.
(4) When selling property or equipment by auction, it shall be given to the person who bids the highest price so as not to fall below the price determined in accordance with section 18.
(5) According to sub-section (4) when property or equipment is sold by auction, the auctioneer shall be given a period of three to thirty-five days depending on the nature of the property or equipment.
(6) If the person who accepted the higher price does not accept the auction or does not come to the auction within the time limit given in accordance with sub-section (5), the deposit held by him shall be forfeited and sold by auction to the person who accepted the second, third and last higher price respectively as required.< br> (7) Even during the proceedings related to auction sale as per sub-section (2), (4), (5) or (6), if no one agrees to the auction, such property or instrument shall be reassessed and reassessed. (8) If the property or equipment cannot be sold by auction even in accordance with sub-section (7), the department or the relevant district administration office shall sell such property or equipment by auction in the form of Kawadi or through negotiation in a suitable manner.
(9) When publishing a notice for auction sale of property or equipment in accordance with sub-section (2) or (7), such notice shall also be published on the department's website.
